Email must be received by 11:59 PM PT to
qualify as an entry for that day's contest.
Five email entries will be randomly
selected per day to win a $20 Visa Gift Card that will expire on August 31,
2010. The gift card will be sent via FedEx.
The Scavenger Hunt begins August 5th and
concludes on August 13th. There will be a new hunt each week day for seven
days.
You must be 18 years old and live in the
United States to participate.

with the following GIVEAWAY TERMS AND CONDITIONS, constitute the “Offer”.
This
is a limited time offer and quantities are limited. No purchase or payment
necessary. This Offer begins on or about August 5, 2010 and continues while
supplies last, but in no case later than 12-31-2010. Open and offered only to legal residents of

five (5) Participants per day during the Offer period who complete and submit
an email entry sent to the designated email address (“Recipients”) who are
chosen at random, will receive a FREE Visa gift card. Limit one (1) submission
per day and one (1) Gift per Participant. Gift may be subject to its own terms
and conditions of use. Allow two (2) weeks for the delivery. Gift is subject to
availability and Cisco reserves the right to substitute a gift of equal value.
No cash alternative available. Participants are solely responsible for any
applicable taxes connected with the Gift.
To the extent allowed by applicable law, Cisco shall not be liable for
any delay, loss, damage, distress or inconvenience for or arising from this
offer, including any Gifts. Personal
data will be processed in accordance with Cisco’s Privacy Policy which can be

Limitation of Liability; Disclaimer;
Indemnification.
A. Liability. UNDER NO
CIRCUMSTANCES WILL EITHER PARTY BE LIABLE TO THE OTHER PARTY FOR INDIRECT,
INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (EVEN IF THAT PARTY HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING IN CONNECTION WITH
THIS AGREEMENT, EVEN IF EITHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES (COLLECTIVELY, "DISCLAIMED DAMAGES"); PROVIDED THAT
PARTICIPANT SHALL REMAIN LIABLE TO WEBEX TO THE EXTENT ANY DISCLAIMED DAMAGES
ARE CLAIMED BY A THIRD PARTY. IN NO EVENT SHALL THE LIABILITY OF WEBEX IN
CONNECTION WITH THIS AGREEMENT FOR DAMAGES EXCEED THE AMOUNT PAID OR PAYABLE BY
WEBEX TO PARTICIPANT UNDER THIS AGREEMENT. IN ANY CASE, WEBEX’S MAXIMUM
CUMULATIVE LIABILITY AND PARTICIPANTS’ EXCLUSIVE REMEDY FOR ANY CLAIMS ARISING
OUT OF OR RELATED TO THIS AGREEMENT WILL BE LIMITED TO $100. Because some
states and jurisdictions do not allow limitation of liability in certain
instances, portions of the above limitation may not apply to Subscriber.
B. Disclaimer of
Warranty. EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, WEBEX
SPECIFICALLY DISCLAIMS ANY, REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED,
REGARDING THE SUBJECT MATTER, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE
OF DEALING OR COURSE OF PERFORMANCE. ADDITIONALLY, ALL OF WEBEX'S AND ITS
PARTNERS' WEBSITES, AND ANY PROPRIETARY SOFTWARE USED TO CONNECT AND CONDUCT
THE WEBEX SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."
Additional Terms
A. Independent
Investigation. Participant acknowledges that Participant has read this
agreement AND AGREES TO ALL ITS TERMS AND CONDTIONS.
B. The provisions of this Agreement are
severable. If any provision of this Agreement, or the application thereof to
any person or circumstance, shall be deemed invalid or unenforceable under any
applicable law, such invalidity or unenforceability shall not affect the other
provisions of this Agreement that can be given effect.
C. No delay or failure by WebEx in
exercising any right under this Agreement, and no partial or single exercise of
that right, shall constitute a waiver of that or any other right.
D. The rights and remedies of WebEx are
not mutually exclusive; that is, the exercise of one or more of the provisions
hereof shall not preclude the exercise of any other provision hereof.
E. This Agreement shall be deemed
a mutual agreement and shall not be construed and/or interpreted in favor or
against either party on the basis of preparation of the Agreement.
F. By applying to the Offer and by
clicking–through the acceptance button to this Agreement, Participant executes,
accepts, enters into, and becomes party to this Agreement, effective on the
date of such acceptance to this Agreement.
G. WebEx reserves the right to modify the
terms and conditions of this Agreement in its sole discretion. If any
modification is unacceptable to Participant, Participants’ sole recourse is to
terminate this Agreement. Participants’ continued participation in the Offer
constitutes Participants binding acceptance to the change.
H. This Agreement shall be governed by the
laws of the State of California (USA), except for its conflict of law
provisions. The exclusive forum for any actions related to this Agreement shall
be in the state courts in Santa Clara County, California, and, to the extent
that federal courts have exclusive jurisdiction, also in Santa Clara County,
California. Participant consents to such venue and jurisdiction.

BY APPLYING FOR THE OFFER A PARTICIPANT IS
SIGNIFYING ITS AGREEMENT TO BE PRESENTLY BOUND BY THE TERMS OF THIS AGREEMENT
TO THE SAME EXTENT AS IF PARTICIPANT HAD PERSONALLY SIGNED THIS AGREEMENT.
